1. Agreement
These Terms of Service ("Terms") govern your use of ebikebeast.com and any purchase you make from eBikeBeast ("we", "us", "our"). By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site or order from us.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract to buy from us. By ordering, you confirm that you meet these requirements and that the information you provide is accurate and complete.
3. Products & pricing
We work to describe and price products accurately, but we do not warrant that descriptions, specifications, images or prices are error-free. Prices are in US dollars and may change at any time. If we discover a pricing or description error affecting your order, we may cancel the order and refund you in full; we will contact you before doing so where possible.
4. Orders & payment
Your order is an offer to buy. Payment is processed securely by Stripe; by paying you authorise the charge for the total shown at checkout. We may accept or decline any order — for example if a product is unavailable, if we suspect fraud, or if there was an error — and if we decline after payment we will refund you in full. A binding contract forms when we confirm your order.
5. Shipping & delivery
Delivery times shown (typically 8–12 weeks) are good-faith estimates, not guarantees; bikes ship factory-direct by ocean freight and must clear US customs. Risk of loss passes to you on delivery. Where duties are not prepaid, you are responsible for any import fees, taxes or charges; we will contact you about any unforeseen government fee changes before delivery. 6. Returns & refunds
Our return and refund terms — including the 60-day return window, the requirement that the bike be in original, unmodified condition, and that the buyer pays return freight — are set out in our Shipping & Returns policy and are incorporated here by reference.
7. Warranty & disclaimer
Bikes carry a 2-year manufacturer warranty covering motor, battery and drivetrain defects; accessories carry a 1-year warranty. Except for these and any warranties that cannot be excluded under applicable law, products are provided "as is" and we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose.
8. Safety, legal use & assumption of risk
Our bikes are high-performance electric vehicles intended for riders who understand and accept the risks of off-road riding. You are responsible for operating any bike safely, wearing appropriate protective gear (including a helmet), and for determining and complying with all laws that apply where you ride — including registration, licensing, insurance, age and where the vehicle may legally be operated. Road and trail legality varies by state and locality; any statement that a model is "road legal" or "trail legal" is general information only and it is your responsibility to confirm legality in your jurisdiction before riding on public land or roads. You assume all risks associated with operating the bike.
9. Limitation of liability
To the fullest extent permitted by law, eBikeBeast and its owners and staff will not be liable for any indirect, incidental, special or consequential damages, or for any loss arising from the use or inability to use a product. Our total liability for any claim relating to a product or order will not exceed the amount you paid for that order. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless eBikeBeast from any claims, damages or expenses arising out of your misuse of a product, your violation of these Terms, or your violation of any law or the rights of a third party.
11. Intellectual property
The eBikeBeast name, logo and site content are our property or used with permission. Product names and trademarks (including Sur-Ron) belong to their respective owners and are used to describe the products we sell. You may not copy or reuse our content without permission.
12. Governing law
These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Utah, unless applicable law provides otherwise.
